Caravan Parks

As in Force at 18 April 1994

Declaration of Caravan Parks and Camping Areas

The Jabiru Town Development Authority may declare land in the town area of Jabiru to be a caravan park or camping area. The area of land and facilities located on Lot 950, town of Jabiru, is a caravan park.

Duties of Lessee

The lessee of a caravan park or camping area must:-

  • maintain the park or area in a clean and hygienic condition, free of fire, health and safety hazards and free of excessive vegetation;
  • cause all garbage bins on the park or camp to be emptied at least twice each week;
  • cause all amenities buildings on the park or camp to be cleaned at least once each day; and
  • ensure that all amenities, ablution and other facilities in the park or camp are maintained in good operating order.

A lessee who fails to comply with this by-law is guilty of an offence and the Penalty is a $500 fine and another $50 for each day the offence continues.

Power of Authorised Officers

An officer authorised by the Jabiru Town Development Authority may, at all reasonable times, enter a caravan park or camping area and inspect:-

  • buildings and amenities that are available for the users of the caravan park or camping area;
  • any thing that is or may be a source of health, safety or fire hazard; and
    other things as are reasonably necessary to ensure that the lessee is fulfilling his duties.

A lessee or a person employed on or who has an interest in the caravan park or camping area that is inspected must give every reasonable assistance to an authorised officer.

A lessee or a person being inspected, if so requested by an authorised officer, must make available any information or documents that he has access to concerning the standards of construction, equipment, plumbing, drainage, sewerage disposal or treatment, lighting, ventilation and electrical installation of the caravan park or camping area.

Report on Inspection

When an authorised officer makes an inspection under these By-laws, he must make a report to the Jabiru Town Development Authority and serve a copy of the report on the lessee.

Following the report, if a lessee is served a notice to rectify any unsatisfactory matters, and fails to comply with the notice within such time as the authorised officer requires, they are guilty of an offence, where the Penalty is a $500 fine and $50 for each day that the offence continues.

Number of Persons in Caravan

An authorised officer may order a lessee to not allow the number of persons living in a caravan or tent to exceed a specified number, if he considers it necessary to avoid a health, safety or fire hazard.

A lessee who fails to comply with such an order is guilty of an offence and the Penalty is a $200 fine and $20 for each day that the offence continues.
